The Revised Uniform Fiduciary Access to Digital Assets Act — adopted in nearly every state — governs when an executor may access someone's digital property. Its core principle is that the client's own written instructions come first. Without them, the platform's terms of service decide, and most default to refusing access.
That's why a will can leave someone everything and still not give them the right to open the deceased's email. The digital-assets codicil grants that permission explicitly, without the client needing their will redrafted.
